1. Scope

These Terms & Conditions govern the use of the KINETIC Perfumes online store available at www.kineticperfumes.com and all purchases made through it.

 

The Website is operated by LUXE LOGISTIC Sp. z o.o., with its registered office in Warsaw, Poland, and an operational office in Barcelona, Spain.

 

By using the Website or placing an Order, you agree to these Terms.

2. Definitions

  • Customer means any individual purchasing Products through the Website.
  • Consumer means a Customer acting outside their trade or profession.
  • Products means all fragrances, Discovery Sets, samples and other goods offered for sale.

3. Eligibility

To place an Order, you must:

 

  • Be at least 18 years old or have parental consent.
  • Provide accurate and complete information.
  • Have the legal capacity to enter into binding contracts.

4. Products

We make every reasonable effort to ensure that product descriptions, images and prices are accurate.

 

Fragrance perception is subjective and does not constitute a product defect.

5. Pricing & Taxes

Prices are displayed in Euro (EUR) and include VAT where applicable.

 

Orders delivered outside the European Union may be subject to customs duties, import charges and local taxes payable by the Customer.

6. Orders

An Order acknowledgement confirms only receipt of your Order.

 

A Sales Contract is concluded only when we confirm acceptance of the Order or dispatch the Products.

 

We reserve the right to refuse Orders due to:

 

  • Product unavailability.
  • Payment authorisation failure.
  • Suspected fraud or abuse.

7. Payment

We currently accept the following payment methods:

 

  • Shopify Payments
  • Stripe
  • PayPal
  • Apple Pay
  • Google Pay

 

Payment must be successfully authorised before Products are dispatched.

8. Shipping

We offer complimentary worldwide shipping.

 

Orders are normally dispatched within one (1) to two (2) business days following successful payment.

9. Delivery

Tracking information will be provided where available.

 

Delivery times are estimates only and may vary due to customs procedures, courier delays or circumstances beyond our reasonable control.

10. Returns & Refunds

Consumers may return eligible unopened Products within fourteen (14) days of delivery.

 

Opened fragrances, Discovery Sets and samples cannot be returned unless they are defective or otherwise non-conforming under applicable law.

 

Approved refunds will be issued using the original payment method.

11. Faulty Products

If you receive a faulty Product, please contact us at info@kineticperfumes.com and include:

 

  • Your Order number.
  • A description of the issue.
  • Photographs where possible.

 

Where required by law, we will repair, replace or refund the Product.

12. Intellectual Property

All Website content, trademarks, logos, product descriptions, images and other materials are the property of LUXE LOGISTIC Sp. z o.o. or its licensors and may not be copied, reproduced or used without prior written consent.

13. Limitation of Liability

Nothing in these Terms limits or excludes any statutory consumer rights.

 

To the fullest extent permitted by law, we exclude liability for indirect, incidental or consequential losses.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to:

 

  • Natural disasters.
  • Strikes or labour disputes.
  • Pandemics.
  • Government actions.
  • Transport disruptions.
  • Telecommunications failures.

15. Governing Law

These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory consumer protection laws applicable in the Customer's country of residence.
